The personal data (“Data”) of users or visitors to this website (“Users”) which is collected, will be managed by FCA Italy S.p.A. (“We, Us”) in accordance with this Privacy Policy. We may have to update parts of this Privacy Policy from time to time because of changes in the law. If we do make any changes, we will publish them on this website. This Privacy Policy came into force on 04.24.2018.

How is Data collected?

Data may be collected in several different ways:

  1. Data, such as contact details, may be provided by customers when they request a specific service;
  2. browsing data, such as IP addresses, pages visited within the website, amount of time spent on the website, and clickstream analysis may be collected when Users visit our websites. While we do not collect this information in order to link it to specific users, it is still possible to identify those users either directly via that information or by using other information collected);

Why is this Data processed?

We will process the Data collected to provide the User with the service they have requested. We will also perform surveys on customer satisfaction related to the quality of our goods and services, provided that it is in our legitimate interests to do so. If a User consents to us doing so, we will send them relevant marketing information and carry out market research about our products and services so that they don’t miss out on current offers. If Users tell us that they want to receive communication that is specific to them, then we will analyse their personal preferences, interests or behaviours so that we can send them customised communication that we think they might like. If Users tell us that they are interested in receiving relevant offers from others companies that might interest them, then we will share their Data with companies in our group and selected partners in the automotive, financial, insurance and telecommunication sectors with whom we work closely. As we are always looking to make the User’s experience better, we also use the Data to improve our websites. We normally process the Data by automated or electronic means through our websites and mobile apps. We also process data through electronic means, including e-mails and by phone (e.g. SMS, MMS and fax).

How long will my data be kept?

In providing services requested, we may store your Data for as long as is necessary to protect our interests relating to potential liability related to that service. We will only keep the Data for as long as is deemed strictly necessary to fulfil the purpose for which it was collected. Consent to marketing and other activities unrelated to the performance of the specific service requested may be withdrawn at any time, following which the Data will no longer be used for that purpose. Although the User will not be contacted for that purpose any longer, we may still store it to protect our interests.

What rights do Users have?

Users have the right to:

  1. know if any Data is being processed by us and, where applicable, have access to it;
  2. rectify any inaccurate information we have or to have it erased when the request is legitimate;
  3. restrict the processing of the Data when the request is legitimate;

FCA Privacy Notice Sales

1 − Personal data provided by the customer to the dealership in relation to commercial relationships, pre-contractual negotiations and the execution of the agreement (hereinafter the “Data”) will be processed for the following purposes:

a. purposes strictly related to the execution of the sales agreement which are instrumental to manage the relationship with the customer and are connected to the dealer’s legal obligations (e.g. accounting and tax law). With reference to processing for these purposes, the dealer acts as data controller of the processing;

b. purposes strictly related to the contractual relationship between the customer and FCA Italy S.p.A. ( “FCA”). Specifically, FCA will process the Data as a data controller to comply with contractual obligations and legal requirements related to warranties, product safety (e.g. recall campaigns); to perform audits at the dealership; to reply and fulfill all customers’ requests; to perform customer satisfaction surveys related to the quality of FCA goods and services pursuant to FCA’s legitimate interests;

c. Dealer Marketing: subject to the customer’s consent, sending commercial communications as well as sending advertising on dealership products and services, or performing market research;

d. FCA Marketing: subject to the customer’s consent, sending commercial communications as well as sending advertising on FCA products and services, or performing market research;

e. Dealer Profiling: subject to the customer’s consent, allowing the dealership to analyze customer behaviour, habits and propensity to consume and to enhance products and services provided by the dealership as well as to satisfy customer expectations;

f. FCA Profiling: subject to the customer’s consent, allowing FCA to analyze customer behaviours, habits and propensity to consume and to enhance products and services provided by FCA as well as to satisfy customer expectations ;

g. Dealer Third Party Marketing: subject to the customer’s consent, communicating Data to the Dealer’s subsidiaries and affiliates, as well as its to partners in the automotive, financial, insurance and telecommunication sectors, that will process them to send commercial communications as well as advertising on those companies’ products and services, or to perform market research;

h. FCA Third Party Marketing: subject to the customer’s consent, communicating Data to the FCA subsidiaries and affiliates, as well as its partners in the automotive, financial, insurance and telecommunication sectors, that will process them to send commercial communications as well as advertising on those companies products and services, or to perform market research.

The Data may be processed in hardcopy, by automated or electronic means including via mail or e-mail, phone (e.g. automated phone calls, SMS, MMS), fax and any other means (e.g. web sites, mobile apps).

2 − Submitting the Data is never mandatory. However, not providing the Data for the purposes provided in paragraphs 1 (a) and (b) will mean that FCA and/or the Dealer will not be able to provide the service, or fulfill the agreement and/or to comply with the obligations arising out of the agreement. If the customer does not consent to the use of their data for the purposes in paragraphs 1 (c), (d), (e), (f) (g) (h), this will not prevent the dealership from executing the agreement or providing the activities related to or deriving from the agreement.

3 – Where the dealer is the data controller (i.e. for the purposes in paragraphs 1 (a), (c), (e), (g)), you can contact them at their registered offices at <address>

4 − For the purposes provided in paragraph 1, Data may be processed by third parties acting on behalf of data controllers, as the case may be identified in paragraph 3, in compliance with contractual requirements, in Member States of the EU or in countries outside of the EU. The Data may be communicated to third parties to comply with legal obligations, to execute Public Authorities orders or to exercise data controllers rights before judicial authorities.

5 - Within their contractual relations data controllers may transfer the Data in countries outside the European Economic Area (EEA), including storing them in databases managed by entities acting on behalf of the data controllers. Database management and Data processing are restricted to the purposes for which they were collected and are carried out according to applicable data protection law. In the event Data is transferred outside the EEA, data controllers will use any appropriate contractual measures to guarantee an adequate protection of the Data including – among the others – agreements based on the standard contractual clauses adopted by the EU Commission relating to the transfer of personal data outside of the EEA.

6- The Data processed in accordance with paragraphs 1 (a) and (b), will be retained for the period deemed strictly necessary to fulfil such purposes. However, the Data might be stored for a longer period in case of potential and/or actual claims and resulting liabilities relating to these purposes. Data processed for Marketing and Profiling purposes will be retained by the data controllers from the moment the customer gives consent until the moment the customer withdraws their consent. Once consent is withdrawn, Data will no longer be processed for Marketing and Profiling purposes, although they might still be kept by the data controllers to manage potential claims and/or lawsuits. Data retention in case of Marketing and Profiling is compliant with the local law and with the decisions of the Data Protection Authority.

7 − The customer has the right to:

I. know if any Data about them is being processed and, where applicable, have access to it;

II. rectify any inaccurate information about them or to have it erased when the request is legitimate;

III. restrict the processing of the Data when the request is legitimate;

IV. portability, where applicable, so that they can obtain the Data in a structured, ordinarily used and readable format, as well as the right to transfer the Data to other controllers;

V. object to the processing of the Data when the request is legitimate; and

VI. lodge a complaint with a supervisory authority in case of unlawful processing of Data.

To exercise these rights, the customer can write to the dealership in relation to the purposes in paragraphs 1 (a), (c), (e), and (g), or, FCA in relation to the purposes in paragraphs 1 (b), (d), (f), and (h) by post to its registered office at Corso Agnelli 200, Turin, Italy or to privacy@fcagroup.com.
